Legal Division Overview

Legal Division Overview

All functions of the Legal Division are executed in alignment with the legislative frameworks governing public entities, including the Constitution, the Public Finance Management Act (PFMA), the Skills Development Act, the Promotion of Access to Information Act (PAIA), the Promotion of Administrative Justice Act (PAJA), and other relevant legislation. The Division ensures the SETA operates lawfully, ethically, and with due governance.

Key Functions of the Legal Division (not limited to the below list)

  • Provide legal advisory services across all strategic and operational matters
  • Draft, vet, and review contracts, memoranda of understanding (MOUs), and service level agreements (SLAs)
  • Ensure compliance with applicable legislation, including labour law, procurement regulations, and administrative lawEnsure compliance with applicable legislation, including labour law, procurement regulations, and administrative law
  • Develop, implement, and review legal and compliance policies and frameworks
  • Manage litigation, disputes, and legal claims involving the organisation
  • Provide support in alternative dispute resolution processes (e.g., CCMA, Labour Court)
  • Ensure sound contract management
  • Promote good corporate governance and ethical practices
  • Provide legal and secretariat support to the Board and its sub-committees, including preparation of agendas, minutes, resolutions, and compliance with the King IV Code
  • Monitor and ensure organisational compliance with regulatory requirements
  • Manage requests and access to information in terms of the Promotion of Access to Information Act (PAIA)
  • Ensure ongoing compliance with PAIA, including updating of the PAIA Manual, processing of PAIA requests, and annual submissions to the Information Regulator
  • Draft legal opinions and interpretation notes to support decision-making
  • Deal with any audit issues on legal, governance and compliance issues
  • Mitigate legal risks and support enterprise risk management activities
  • Coordinate with external legal counsel and regulatory authorities
  • Provide legal training and awareness sessions to internal stakeholders
